Welcome to Gloam! These Terms of Service (“Terms”) govern your use of the Gloam platform, website (trygloam.com), and all related services (collectively, the “Services”). By accessing or using Gloam, you agree to these Terms. If you don’t agree, please don’t use our Services.

1. Who Can Use Gloam

You must be at least 18 years old and able to form a binding contract to use Gloam. By using our Services, you represent that you meet these requirements.

2. Your Account

  • You’re responsible for maintaining the security of your account and password.
  • You agree to provide accurate, up-to-date information.
  • You’re responsible for all activity that occurs under your account.
  • If you believe your account has been compromised, contact us immediately at hello@trygloam.com.

3. Subscriptions, Payments & Refunds

  • Gloam is a subscription service. Fees, billing cycles, and features are described on our pricing page.
  • Payments are processed securely by our payment processor.
  • All fees are non-refundable except as required by law or as stated in a specific promotion.
  • We may change pricing with at least 30 days’ notice.

4. Acceptable Use

You agree not to:

  • Use Gloam for unlawful, harmful, or abusive purposes.
  • Attempt to access or tamper with other users’ data.
  • Reverse engineer, decompile, or attempt to extract source code.
  • Upload viruses or malicious code.
  • Use automated scripts to scrape, access, or interact with the Services in a way that degrades performance.

We reserve the right to suspend or terminate accounts that violate these rules.

5. Your Content & Data

  • You retain all rights to content you upload or create in Gloam (e.g., client info, contracts, images).
  • You grant us a limited license to use your content only as needed to provide and improve the Services.
  • You are responsible for ensuring you have the right to upload and process your clients’ data.

6. Integrations & Third-Party Services

  • Gloam may integrate with third-party services (e.g., Gmail, Stripe, OpenAI).
  • Use of these integrations is subject to the third party’s terms and privacy policies.
  • We are not responsible for the actions or data practices of third-party services.

7. Intellectual Property

  • All Gloam software, branding, and content (except your uploaded content) is owned by Gloam or its licensors.
  • You may not use our trademarks, logos, or branding without our written permission.

8. Disclaimers & Limitation of Liability

  • Gloam is provided “as is” and “as available.” We make no warranties about uptime, accuracy, or fitness for a particular purpose.
  • To the fullest extent permitted by law, Gloam and its team are not liable for any indirect, incidental, or consequential damages arising from your use of the Services.
  • Our total liability is limited to the amount you paid us in the 12 months prior to the claim.

9. Termination

  • You may cancel your subscription and delete your account at any time.
  • We may suspend or terminate your account if you violate these Terms or use Gloam in a way that could harm us or others.
  • Upon termination, your right to use the Services ends immediately, but sections regarding intellectual property, disclaimers, and limitations of liability survive.

10. Changes to These Terms

We may update these Terms from time to time. We’ll notify you of material changes via email or in-app notice. Continued use of Gloam after changes means you accept the new Terms.

11. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Any disputes will be resolved in the courts of Orlando, Florida.

12. Email Communications

By creating an account or using Gloam, you agree that we may use your email address to send you important information related to your account, service updates, security alerts, and other essential communications required to operate the platform.

We may also send you product updates, tips, and marketing messages about Gloam or related services. You can opt out of marketing emails at any time by clicking the “unsubscribe” link in those emails or by contacting us at hello@trygloam.com. However, you will still receive essential service emails (such as billing, security, or critical product changes) as long as you have an active account.
